STATEHOUSE (April 24, 2025) – State Rep. Ed Soliday's (R-Valparaiso) legislation to keep a balance between building new generation sources and overbuilding at the expense of ratepayers, a priority for the Indiana House Republicans, heads to the governor's desk to be signed into law.
As Indiana continues to attract more industry, the demand for electricity grows at a more rapid pace than previously anticipated. House Enrolled Act 1007 would provide incentives, such as a tax credit, to attract small modular nuclear reactor (SMR) manufacturers to Indiana, increasing industry and diversifying our generation types.
"SMRs are the future of efficient, clean and affordable energy," said Soliday, chair of the House Utilities, Energy and Telecommunications Committee. "This legislation paves the way for new generation without burdening the ratepayers."
SMRs are compact sources of energy that can be used alone or with other similar sources to create energy for a single location or numerous residential, commercial and industrial locations. Companies that need large amounts of energy may be able to utilize SMRs to supplement generation without burdening the grid.
House Enrolled Act 1007 would also require large load customers, a customer generating at least 150 megawatts, who are looking to construct new energy generation such as natural gas or SMRs, for their facility, to pay for 80% of the construction cost of any new generation capacity they need, whether they complete their new facility or not.
Additionally, Soliday said this legislation ensures Indiana does not close current generation facilities unless the utility can prove to the Indiana Utility Regulatory Commission that the closure will financially benefits consumers and there is equal or greater new generation to replace it.
Under House Enrolled 1007, the Indiana Economic Development Corporation must disclose any potential new or expanding facility with a demand of at least 20 megawatts to the impacted utility and the IURC within 15 days of the build or expansion.
