STATEHOUSE (Feb. 27, 2026) – State Rep. Hunter Smith (R-Zionsville) authored a bill that provides a new and liberty-minded structure for local, homegrown food producers that now goes to the governor for consideration as a new law.
House Enrolled Act 1424 will make Indiana the nation’s leader in the food freedom space. This landmark legislation for homestead vendors and small farms expands the liberties of producers while preserving the existing home-based vendor code. Producers may continue operating under the current home-based vendor statute or opt into the new homestead vendor and small farm category, which provides a lighter regulatory approach.
“Local, homegrown food producers are key to the future of Indiana’s public health as well as its economies and rural communities.” Smith said. “This bill places freedom and autonomy back into the hands of producers and the preferences of consumers. Food knows no party. Health knows no party. This is a measure that will benefit all Hoosiers.”
The legislation allows in-state shipping and delivery if producers obtain a Safe Serve ANSI-accredited food handler certificate and ship products in sealed packaging, while requiring proper refrigeration and safe storage and transportation to prevent contamination. It also clarifies that local health officials may investigate food-borne illness complaints, though homestead vendors and small farms remain exempt from local permitting requirements.
Smith said the bill holds promise for local producers to grow their operations, reinvest in their communities, and expand Indiana’s local food economy.
