Rep. Smaltz's bill to strengthen sex offender relocation rules signed into law

STATEHOUSE (April 17, 2025) – Legislation authored by State Rep. Ben Smaltz (R-Auburn), which aims to enhance safeguards against registered sex offenders was signed into law by the governor.

House Enrolled Act 1687 reinforces probation requirements for sex offenders requesting to locate to another county by introducing additional factors for judges to consider before granting approval for the transfer. These include whether the individual has close family ties, such as a spouse, parent or adult child, in the area, as well as stable housing and employment opportunities. Smaltz said these measures aim to prevent unrestricted movement of sex offenders into communities where they could pose a threat to public safety.

"By requiring judicial approval at both ends of a relocation, we are strengthening protections to reduce potential risks to public safety," Smaltz said. "Many of the sex offenders from Northeast Indiana didn't offend in Northeast Indiana and current laws don't do enough to ensure proper oversight. House Enrolled Act 1687 closes those loopholes and prioritizes the safety of Hoosier children and families."

Smaltz emphasized that protecting the safety and well-being of Hoosier communities remains a top priority.

This legislation requires that if a sex offender seeks to relocate to another county, the supervising court in the current county must issue an order permitting the move, and the receiving county's judge must formally approve the transfer. This ensures the receiving judge is aware of the move and can make law enforcement aware of the offenders presence in the community to properly monitor their activities. Smaltz said the bill enhances employment restrictions by prohibiting sexually violent predators and offenders against children from working in positions where they could have significant contact with minors.
