STATEHOUSE - House Concurrent Resolution 5 will was adopted by the House of Representatives by a vote of 70-17. HCR 5, which was filed by Representative David Frizzell (R-Indianapolis), urges all agents of the federal government to cease and desist immediately all mandates that are beyond the scope of their constitutionally delegated powers.

"The purpose of this resolution is to send a message to our federal delegation that Indiana does not need federal mandates, more specifically a federal healthcare mandate," said Rep. Frizzell. "The constitution clearly defines Indiana's sovereignty in the 10th amendment, and this resolution is a reminder to the federal government of that balance of power."

Recently two separate federal judges have ruled the recent federal healthcare law unconstitutional on the grounds that a federal healthcare mandate in the law breaks the commerce clause in the Constitution.
