A recent article in the Evansville Courier & Press caught my attention. Entitled “Crash Rash,” the story highlights several accidents involving motorized scooters, or mopeds, the injuries and blood alcohol content of those involved and the perceived need to create new or update existing regulations.

In addition to this story, I have received numerous emails, phone calls and letters about this issue and have read about accidents around the state and right here in Evansville involving mopeds from many different news sources. Many people have contacted me, urging the Legislature to take action in the coming session and please believe me, I’m interested in what you have to say.

Before I get into that though, first let me give you a brief background on the current laws regarding mopeds and moped safety. According to current Indiana law, a moped or “motorized bicycle” is defined as “a two or three wheeled vehicle that is propelled by an internal combustion engine or a battery powered motor.” 

Some laws regarding moped operation include:
Operator must be at least 15 years old
Operator must have a Bureau of Motor Vehicles issued license or ID card
Drivers under 18 must wear a helmet and eye protection
Mopeds cannot be driven on sidewalks or Interstate highways
Headlights and taillights required if driving after sunset or before sunrise
Mopeds must have a muffler in good condition and in continual operation 
Mopeds may not travel above 25 miles per hour 

Fines for violating these laws are between $112 and $150. 

Many say that these laws need to be updated or changed to put in place laws more like those for motorcycle operators, with higher fines and more regulations, such as requiring insurance. Others argue that stricter enforcement of current laws would solve many of the problems associated with moped accidents and complaints.

Updating moped laws in Indiana is something I am interested in pursuing if it is truly action that needs to be taken. Before I start that process though, I would like to hear from you and find out exactly what parts of the law –if any - you think need to be changed.
