STATEHOUSE (April 11, 2017) – State Rep. Doug Miller’s (R-Elkhart) bill allowing local governments to release performance bonds more quickly could soon be law.
Currently, local governments give contractors a performance bond based on the value of the structure they are building. Miller said if a delay in the project occurs, the area being constructed is in limbo, postponing all other scheduled projects.
According to Miller, House Enrolled Act 1117 accounts for delays that tend to happen on worksites, and would give local governments the ability to partially release performance bonds to let contractors begin another building project.
“My goal with this legislation is to help our local communities complete more projects by unfreezing and partially releasing these bonds,” Miller said. “If signed into law, this proposal would promote revitalization and boost Elkhart’s economy.”
House Enrolled Act 1117 now heads to the governor for consideration as a new law.
