STATEHOUSE (March 25, 2021) – The Indiana General Assembly voted unanimously in support of State Rep. Peggy Mayfield's (R-Martinsville) legislation that would strengthen guidelines to establish, expand or dissolve fire protection territories. The bill cleared both chambers without any opposition.
A fire protection territory is an agreement between at least two government entities to ensure reliable fire and emergency services for a specific area. Mayfield drafted her legislation after a fire protection territory in Monroe County faced criticism over a perceived lack of transparency and the potential for conflicted representation on the board.
Taxes levied by the participating units of a fire protection territory can be different rates, therefore, residents can incur substantially different property tax increases. Adding a residency requirement for board members would help ensure everyone facing a potential tax increase is fairly represented.
Current law mandates two public hearings, but the first hearing is when the information is initially distributed and the second hearing is typically immediately before the vote. Mayfield's bill would add a third public hearing at least 10 days before the vote to allow for more input from residents to be considered.
This legislation would simplify the procedure for expanding a fire protection territory, as well as required steps for dissolving a territory.
"Every community that is part of a territory brings assets and liabilities to the table," Mayfield said. "Under this proposal, communities would have to explain, in writing and upfront, what assets they're bringing to the arrangement and what would happen to these assets, as well as any jointly acquired assets, if a unit withdraws. This legislation strengthens transparency, encourages public engagement and provides for adequate representation of the taxpayers' interest. These partnerships are important for Hoosiers' safety in our rural areas, and a more transparent process to form and operate them can only add to public confidence."
