STATEHOUSE (Feb. 14, 2025) – The Indiana House of Representatives recently advanced legislation to appoint additional magistrates to improve the efficiency of Elkhart County's court system.
According to the 2023 Weighted Caseload Measure Study, Elkhart ranked fifth out of Indiana's 92 counties in severity of need for judicial officers. In recent years, Elkhart County attempted to address its growing demand by implementing specialized court programs and enhanced pretrial services. However, these efforts have not fully addressed the strain caused by continued population growth.
House Bill 1144 assists Elkhart County in addressing its heavy caseloads by allowing an increase from two to five full-time magistrates to be jointly appointed by the Elkhart circuit and superior courts.
"The courts are a vital part of upholding public safety and criminal justice in Elkhart County," said State Rep. Tim Wesco (R-Osceola). "Our constitution states justice shall be administered swiftly and without delay."
A magistrate performs many of the same duties as a judge, such as conducting trials, imposing sentences and handling administrative matters, allowing judges to focus on more complex and high-priority cases.
"By establishing additional magistrates in Elkhart County courts, they will be able to conduct hearings more efficiently and effectively," said State Rep. David Abbott (R-Rome City).
"Though we've tried different measures in the past to combat heavy caseloads in Elkhart County, this legislation would be much more effective in alleviating the burden local courts currently face," said State Rep. Joanna King (R-Middlebury).
Filed case numbers from 2023 included over 12,000 civil cases and more than 9,000 criminal cases in Elkhart County, demonstrating the need for additional judicial staff to assist with the workload.
"This legislation would not only improve efficiency in our court system but would also help uphold the promise of swift and fair justice for Hoosiers in our community," said State Rep. Doug Miller (R-Elkhart).
