STATEHOUSE (April 14, 2026) – The governor recently ceremonially signed a new bipartisan law authored by State Rep. Julie McGuire (R-Indianapolis) to provide greater transparency and oversight to child fatality investigations by the Indiana Department of Child Services.
According to the most recent Annual Report of Child Abuse & Neglect Fatalities, DCS investigated 276 child fatalities in 2024 where abuse or neglect was suspected or a child younger than 3 died suddenly, unexpectedly or without explanation. That was an increase from 2023.
"Currently, DCS is restricted from sharing much information in child fatalities because of confidentiality, but that often leaves the public and lawmakers in the dark on what led to these situations and how stakeholders can work together to prevent horrific abuse of Hoosier children going forward," McGuire said. "We need major reforms to ensure more of these kids aren't falling through the cracks."
Through House Enrolled Act 1257, starting July 1 DCS must promptly disclose key information in child fatality and near-fatality cases to the public, including whether the agency had prior or current involvement with the child or family. The law also adds legislative representation to the State Child Fatality Review Team to strengthen oversight, requires additional details in Indiana's annual child fatality report and allows lawmakers more access to case reviews that could lead to future laws to better identify failures and prevent future tragedies.
