INDIANAPOLIS (Feb. 1, 2016) – The Indiana House of Representatives passed legislation with a vote of 92-0, that would provide more transparency for residents of homeowners associations.
State Rep. Woody Burton (R-Whiteland) authored House Bill (HB) 1222 to eliminate unnecessary red tape and require additional protections for members of homeowners associations. If enacted, this bill would increase transparency, giving members greater access to meetings and deliberations over proposed rule changes.
“Transparency is the ultimate goal of HB 1222, and I am confident that this legislation addresses those concerns, while still making condominiums and homeowners associations’ actions and meetings transparent for their members,” Burton said.
Last year, Burton authored legislation that created guidelines for homeowners associations and their members. After working with different organizations, Burton became aware of changes that needed to be made. To address these needed changes, HB 1222 would remove the requirement that eligible mortgage holders needed to provide written consent when dealing with a change to a declaration or governing document of homeowners associations.
This legislation would also require a homeowners association to provide notice of proposed amendments and would entitle co-owners and association members to attend any meeting held by the board, including an annual meeting. Additionally, for those who report suspicious or criminal activity in their community, the board would be required to keep their identity confidential.
